Immigrant Investor visa categories allow for conditional residency and eventual lawful permanent residency for persons who invest at least the legally required minimum in a new commercial enterprise that creates at least ten full-time jobs for U.S. citizens, green card holders, or authorized workers per investor. Foreign nationals planning an EB-5 investment are given two options: they can either make an indirect investment through a regional center or invest directly into their own business. Currently, the minimum legally required is USD 1,050,000 or 800,000 in “targeted employment areas” (TEAs).

Can Family Members also Receive Immigrant Visas?

The EB-5 visa process bestows U.S. permanent resident status upon EB-5 investors and their immediate family members. Referred to as derivative beneficiaries, the spouse and any unmarried children under the age of 21 acquire their U.S. green cards concurrently with the primary applicant, who is the EB-5 investor in this instance.
